Terms of Service

1. Acceptance of Terms

By accessing or using Scancrate(the “Service”), operated by Company Name B.V., you agree to be bound by these Terms of Service (“Terms”). If you do not agree to these Terms, you may not use the Service.

2. Description of Service

Scancrate is a web application provided by Company Name B.V.. We reserve the right to modify, suspend, or discontinue any part of the Service at any time without prior notice.

3. Account Registration

To use certain features of the Service, you must create an account. You agree to:

  • Provide accurate, current, and complete information during registration.
  • Maintain the security of your password and accept responsibility for all activity under your account.
  • Notify us immediately at support@example.com if you suspect unauthorised access to your account.

You must be at least 16 years of age to create an account, in accordance with Article 8 GDPR and the Dutch UAVG.

4. User Responsibilities

When using the Service, you agree not to:

  • Violate any applicable laws or regulations, including Dutch and EU law.
  • Attempt to gain unauthorised access to any part of the Service or its related systems.
  • Use the Service to transmit harmful, offensive, or unlawful content.
  • Interfere with or disrupt the integrity or performance of the Service.
  • Use automated means (bots, scrapers, etc.) to access the Service without prior written permission.

5. Intellectual Property

All content, trademarks, and other intellectual property associated with the Service are owned by or licensed to Company Name B.V.. You may not copy, modify, distribute, or create derivative works from any part of the Service without our express written consent.

Any content you submit or upload to the Service remains your property. By submitting content, you grant us a limited, non-exclusive licence to use it solely for the purpose of providing the Service.

6. Privacy

Your use of the Service is also governed by our Privacy Policy, which describes how we collect, use, and protect your personal data in compliance with the GDPR and the Dutch UAVG.

7. Disclaimers

The Service is provided “as is” and “as available” without warranties of any kind, whether express or implied, to the extent permitted by Dutch law. We do not warrant that the Service will be uninterrupted, error-free, or secure.

8. Limitation of Liability

To the maximum extent permitted by Dutch law, Company Name B.V. shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of, or inability to use, the Service. Our total liability for any claim arising from these Terms shall not exceed the amount you have paid us in the twelve (12) months preceding the claim.

Nothing in these Terms excludes or limits our liability for damages caused by intent or gross negligence (opzet of grove schuld), as required under Dutch law (Article 6:233 BW).

9. Termination

You may stop using the Service and delete your account at any time. We may suspend or terminate your access to the Service if you violate these Terms, with reasonable notice where possible.

Upon termination, your right to use the Service ceases immediately. We will delete your personal data in accordance with our Privacy Policy.

10. Changes to These Terms

We may update these Terms from time to time. Material changes will be communicated via the Service or by email. Continued use of the Service after changes take effect constitutes acceptance of the revised Terms.

11. Governing Law and Disputes

These Terms are governed by the laws of the Netherlands. Any disputes arising from these Terms or your use of the Service shall be submitted to the competent court in Amsterdam, the Netherlands, unless mandatory consumer protection law provides otherwise.

If you are a consumer within the EU, you may also use the European Commission's Online Dispute Resolution platform at ec.europa.eu/consumers/odr.

12. Severability

If any provision of these Terms is found to be unenforceable or invalid by a court, the remaining provisions shall continue in full force and effect.
